Borat wins DVD lawsuit

...but gets hit by another

A judge has rejected a bid by two college students to block the DVD release of Borat.

The frat boys had also demanded that a scene showing them making racist and sexist comments be removed from the movie.

But after hearing arguments from both sides, West Los Angeles Superior Court Judge Joseph S. Biderman refused to block the DVD.

The students – who do not use their names on the lawsuit - claim film-makers got them drunk and duped them into misbehaving on camera.

Their case – in which they seek unspecified damages for becoming ‘the objects of ridicule, humiliation, mental anguish, and emotional and physical distress’ – will still go ahead, although no trial date has yet been set.

Meanwhile Sacha Baron Cohen has received another lawsuit over the movie – over a scene that did not even make it to the final version.

An unnamed diner at Ristorante Divino in Columbus, Ohio, is suing after the bogus Kasakh reporter cornered him in a toilet.

The scene, below, has Borat as a toilet attendant who asks a man if he needs help urinating, and in the words of the lawsuit, showing "blatant and shocking disregard" for the man's privacy.

The clip was not used in the movie, but it did appear in a TV special in America.

Attorney Jonathan Milling says his client did not know he was being videotaped, and didn't even know the scene existed until this autumn when a friend in another state recognised him on TV.
